Election Fraud allied with Political Extremism


Distribution Proviso

Independent investigation by law enforcement agencies involves an alleged pattern or practice of joint and several illegal or criminal activities by: National Union of Journalists (NUJ) executives, lawyers, and staff; National Executive Council (NEC) officers; and, London Freelance Branch (LFB) officials.

The author has little personal knowledge of other branches and chapels which do not form part of intended civil and criminal complaints; therefore, he has no opinion on their activities. Adverse comments, all verified and validated to insure accurate reporting, meet legal requirements.


Timothy R Gopsill, Editor, Journalist, National Union of Journalists (NUJ) magazine has compulsorily retired and voting has begun to elect a new editor from among eight candidates. Under NUJ rules, the editor must face re-election every five years until reaching age of 60. Gopsill elected twice and elected unopposed twice has held the editor’s job for 21 years. The election has generated considerable controversy given the recent perverse behavior of officers and officials which includes prior restraint, misappropriation of member and government funds, and manipulated, unopposed elections.

Journalist magazine quotes Jeremy Dear, General Secretary, as saying that the full cost of employing the editor amounts to £65,000 (actual salary £45,000) and that he last stood for election in 1998. The salary offered in the current election costs members £51,0000 plus expenses and benefits.

A legacy awaits whoever wins the election for editor. It includes both civil and criminal charges also a petition for a public inquiry. Arguably, it could make the successful candidate liable as an accessory after the fact if, as editor, that person does not immediately mitigate the illegal circumstances that Jeremy Dear and Timothy R Gopsill have either caused or neglected to address.

Since Former NUJ General Secretary John Foster retired, both Dear and Gopsill have operated an illegal prior restraint using a media blackout for almost nine years. A Washington Supreme Court unanimous decision by nine judges (30 Mar 06) cleared the NUJ member subject to that media blackout of any wrongdoing; however, Dear and Gopsill ignored that significant decision for all members to continue their prior restraint and to launch a smear campaign. Foster has released an election statement from his Dorset home which does not include NUJ Left.

A few extremists have highjacked NUJ and now belligerently dominate both National Executive Council (NEC) and NUJ administration. They have destroyed the democratic rule that once existed by utilizing member apathy and lethargy (or naivety) supported by election fraud to implement an undemocratic ideology. NUJ practices have moved away from the basic principles of trade union democracy: due process and freedom of expression through solidarity.

NUJ administrators now follow illegal practices that allow elected and appointed officers to usurp power by subverting elections and mandated procedures to benefit themselves financially. The machination includes unopposed election, sycophancy, rogue lawyers, propaganda, media censorship, and coercion. The election of another extremist in the present election will result in catastrophe for principled leadership because it will give absolute ideological control of both printed and online NUJ media to a special interest group known as NUJ Left.

According to Mark Watts, a candidate in the election for a new Journalist editor, NUJ Left can muster 400 votes from the union's estimated 40,000± voting members. He believes that could swing the election for the £51,000.00 a year position if a low turnout occurs. By not voting, members will allow election of an unsavory character to control the medium and the message which eventually gives them control of the union. Historically, people of this ilk spend their first term engineering unopposed reelection as Dear did during his first term.

Watts variously claimed:

A political faction that calls itself NUJ Left is trying to take control of the NUJ. I bet you’ve never even heard of NUJ Left’ Don’t worry, I hadn’t either. I’ve never seen it mentioned in the Journalist. Don’t get me wrong, the NUJ Left doesn’t have overall control of National Executive Council (NEC) – not yet. They’re trying to put their man in charge of the Journalist. With that, they’ll be in an ideal position to take control of our union completely. Right now, this faction controls a big chunk of the NEC and wields heavy influence over its decisions. They do this partly by working, in effect, as a political party, partly by some good old-fashioned tub thumping. Election Fraud

If forty thousand NUJ members (Dear has withheld the actual number) give about 400 NUJ Left extremists carte blanche to do what they wish, then they have only themselves to blame for continuation of the catastrophic leadership of the union since Jeremy Dear, NUJ General Secretary took office (01 Feb 02) and a takeover by NUJ Left.

Supported by out-of-work, sycophantic freelances hungry for an expense account, Dear has changed the largest journalist union in the world, once internationally respected as a legitimate organization, into an extreme left-wing oligarchy with undemocratic and illegal propensities.

The present election overcomes the anarchy to some degree by eight candidates standing for election. However, the downside of that improvement relates to apathy and lethargy by members who do not vote which will allow a pernicious minority to gain election. That points to a real need to actively promote opposing candidates in elections to insure that incumbents do not retire in place.

Members must learn from the current situation and overcome the extant apathy to insure that multiple candidates run for all elected positions: essential to maintain democracy and dispose of recalcitrant cabals.

NUJ cabal (clique), an exclusive circle of officials and officers, has clandestinely usurped power and performed illegal acts for political expedience and personal gain after arrogating trade union power in violation of the Trade Union and Labour Relations (Consolidation) Act 1992. Officials and officers have, jointly and severally, denied member rights and due process of law. By that, they have obstructed justice to the detriment of all members.

Two complaints filed against NUJ with David Cockburn, Certification Officer, Certification Office for Trade Unions and Employers' Associations did not receive due process. Instead, Cockburn stonewalled investigation and adjudication for five months. By that, he effectively granted NUJ officers and officials impunity to extend a seven-year pattern of silent withholding and election fraud for another year. The illegal merry-go-round continues.

Previous Fraud

NUJ London Freelance Branch (LFB) serves as an example of the procedures extant in NUJ head office. LFB has established a pattern or practice of violation of election rules in order to set up a self-perpetuating, self-interested oligarchy without giving all LFB members an opportunity to participate or to vote by inclusive balloting.

To that end, they have slanted web site information to facilitate election, reelection, or self-succession by preferred officers not on a basis of member service but for ideological reasons and financial reward. Both NUJ and LFB officials use silent withholding of agendas and minutes to facilitate election and reelection unopposed or for self-succession. A show of hands without tellers frequently declares spot-nominated candidates elected unopposed, sometimes in their absence. The secretary then restricts access to minutes, an act that supports manipulation of procedures.

A reasonable person must assume that an annual general meeting attended by between 30 and 50 members of whom about 50% can vote (out of a total branch membership of 3731 eligible to vote) does not allow fair and unbiased nomination or election. That has become abundantly clear during the past seven years with officers effectively succeeding themselves or taking part in swap meets: informal barter of available positions to avoid self-succession. The unopposed reelection of Dear as general secretary provides another example. A real irony exists in a trade union where members, through their own apathy, allow a semi-literate commissar to run for reelection unopposed. Probably more important, they have allowed him to appoint sycophants to impose his totalitarian, politically correct principles, and a reign of terror that deprives members of their humanity and human rights. Coercion not to run for office to allow undemocratic, unopposed reelection frequently occurs.

Jeremy Dear attended a National Executive Council (NEC) meeting (26 Oct 01) at which NEC announced his election as NUJ General Secretary (effective 01 Feb 02). Constituents returned 6,402 papers out of 24,872 issued and Dear received 3,427 votes. Following his election LFB newsletter proclaimed: Hail to the chief Jeremy Dear, General Secretary of the NUJ. . . . pledged to “protect journalists and journalism; tackle copyright grabs and improve freelance rates”. Dear returned unopposed in 2006 for an additional five-year term. An NUJ general secretary has not previously returned unopposed in over a century.

During his first term, Dear surrounded himself with sycophants that insured his reelection unopposed as often occurs in despotic regimes. Jubilation about that reelection seems ludicrous. Dear received a salary and benefits of £73,990.00 for the fiscal year ended 30 September 08, funded from member dues. Dear will remain as general secretary until (31 Jan 12) unless impeached.

John Toner, National Freelance Organizer has neglected to provide documents and information on LFB elections three times. He has covered up illegal activity by denying access to documents and information that names candidates, nominators, seconders, votes received, and balloting method. Dear has neglected to supply information about the actual salary and benefits offered to the new Editor (rumored to be £51,000.00/pa plus benefits and expenses) or to provide dates, voting statistics, and criteria from the last two elections which reelected Timothy R Gopsill as Journalist editor.

In a cover-up of his own lack of credentials, Dear answered a request for his curriculum vitae by falsely claiming exemption under Data Protection Act without substantiating his claim. The author wrote:

PT-08-0820-1034. You have neither answered my questions nor supported your contentions. I am not willing to accept statements that you allege have been made by anonymous individuals. You must support your statements with legal citations or precedents and append a copy of the Information Commissioner's findings that you cited.

Dear replied:

JD-08-0820-0915. I repeat that to release the personal information requested would be a breach of the Data Protection Act principles. It is personal information to which a 3rd party does not have the right of access. We have had this position confirmed by the Information Commissioner's service on 19 August 2008.

Dear, widely known as a pathological liar, has not provided a copy of the commissioner’s report despite repeated requests to verify his claims to exemption.

Pathological liars lie incessantly to get their own way and do so with little concern for others. Often viewed as a coping mechanism developed in early childhood, this sociopathic dysfunction usually manifests in men over forty years of age. It includes displacement, a defense mechanism that transfers affect or reaction from oneself to another person and other types of mental health disorders. [Sociopath]

Sociopaths function by goal-oriented manipulation, cunning, and self-aggrandizement. They have little regard or respect for the law or the rights and feelings of others. NUJ Left

In his manifesto for election as the next editor of Journalist magazine, Mark Watts refers to NUJ Left as a cabal. The term “cabal” defines as a clique (often secret) that seeks power usually through intrigue. Conspiratorial in nature, cabals carry out harmful or illegal political plots.

Since its inception NUJ Left has acted as a rogue, extremist group within NUJ with its principle objective to take over the union and illegally deny trade union rights to members with whom it disagrees. Democratic trade unionism in no way supports that Marxist dogma.

Watts, who as a candidate has a vested interest in the NUJ Left candidate (Richard Simcox) not succeeding wrote:

The fact that the group is “left-wing” is irrelevant: a cabal in the NUJ is poisonous regardless of its political hue, extreme or otherwise. . . . crucially for this election, it [NUJ Left policy] includes: Identifying and targeting key elected posts and NEC seats, democratically agreeing slates for elections, and campaigning for NUJ Left candidates, to advance our influence and further develop equality representation on policy-making bodies and through other structures of the union.

Simcox, when challenged at the Manchester hustings about those statements added “but not solely” to the statement that NUJ members (by extension NEC) remained accountable to NUJ Left. Some candidates used the term “comrade”, sometimes sarcastically.

Dear (who has a long history of withholding documents from members using fatuous excuses) neglected to respond to a request for a copy of the NUJ NEC minutes containing the NEC resolution that authorized formation of NUJ Left as an independent political (activist) entity within NUJ and the NUJ rule that allowed that decision. That request also asked him to confirm or deny his membership in NUJ Left, determined as a blatant conflict of interest and grounds for impeachment. [NUJ Left]

Dear also neglected to send a copy of the draft contract for the new editor already distributed to candidates. Members discussed that contract which relates to full-time employment as editor and possible conflict of interest at the hustings.

Internet Denial of Service Attacks (DoS)

Five cyber-terrorist Internet denial-of-service (DoS) attacks occurred (24-27 Oct 09) since publication of an article by Dominic Ponsford, Editor, Press Gazette commenting on election content disseminated by Mark Watts. Ponsford generated heated argument by NUJ officials, officers, and members. Some of those comments linked to NUJ Club JournoScam web site. [Press Gazette] [NUJ Club Journoscam]

The DoS attacks specifically targeted articles associated with election of a new editor for Journalist magazine and commentary relating to dereliction by the present editor Timothy R Gopsill. The hacker used a self-propagating virus to access the local database as a spam email attachment at about the time that he accessed the US web site to vandalize the same data (23 Oct 09).

Sources have determined that NUJ officials negotiated with the hacker to effect this prior restraint. Damage that followed publication of the Press Gazette article cost £5,500.00 which does not take into account publishing losses which continue to accrue. The hacker repeated the web vandalism at 24-hour intervals which cost £1,000.00 each time to repair. Total damage now amounts to £10,500.00.

As of this update (30 Nov 09), NUJ officials have instructed the hacker to ratchet up coercion by specifically deleting this page and the home page from the web also by vandalizing reference data which has necessitated reprogramming. Metropolitan Police, Computer Fraud Unit and Federal Bureau of Investigation have received details. [Election Cyber-Terrorism]

They reveal how people in authority use retaliatory measures and propaganda to destroy the reputations of people who report illegal activity and racism.

Details of academic credentials and professional qualifications counter record falsification, withholding, and destruction, also forgery by registrars at Rensselaer Polytechnic Institute and University of Washington. Some articles challenge libel/slander maliciously circulated as part of an international campaign of character assassination, personal vilification, subornation, and perjury to effect prior restraint.

Jeremy Dear, NUJ General Secretary recently joined in that defamation. He muckraked to find and extract libelous statements and used them out of context. That suited his purpose to defame the author and to cover-up his eight-year neglect to support him on issues that affect all journalists. NUJ media blackouts cover up his dereliction.

Roy Martin Mincoff (NUJ in-house solicitor) negotiated a £262,000.00 quid pro quo between NUJ and the author's member of parliament, Gareth R Thomas MP (Harrow West), Minister of State, Department for International Development in a distinct conflict of interest. Both Mincoff and his predecessor Claire S Kirby (Thompsons Solicitors, Cardiff) are under investigation by Solicitors Regulation Authority for professional misconduct. Criminal complaints are pending against NUJ officials and NEC officers for fraud and neglect to provide member services.

Nothing Succeeds
like Excess

Freedom of speech, an absolute right not an abstract philosophy, should not subserve economic considerations.

Moreover, information technology remains a right not a privilege despite technocratic claims to the contrary.

Legislative and judicial decisions have determined the right of individuals to distribute information freely.

Laws do not provide much protection when despotic administrators interfere with computer resources because they disagree with the content of messages: a disagreement probably based upon disclosure of their own malfeasance.

They fear dissent and have an aversion to controversy. Their addiction to political correctness frequently causes them to invoke censorship of Internet activities.

They not only empower their systems administrators to handle frivolous email complaints by arbitrarily removing computer access but also allow them to censor incoming mail - an outrageous invasion of personal privacy.

They act upon an irrational expectation that certain categories of email may contain something that they would not wish others to read then arbitrarily reject it.

Interference with email transmission not specifically proscribed by international law classifies as a serious offense which National Union of Journalists officials should note.
