NEC officers and full-time paid employees (officials) have received a copy of this letter which gives them an opportunity to consult independent legal counsel about their joint and several liability prior to the NUJ Finance Committee meeting on Thursday 25 June 2009. For their own protection, they should consider the criminal nature of complaints and current involvement of law enforcement agencies.

The distribution proviso does not classify as a prior restraint or censorship; instead, it meets an ethical responsibility for litigants not to publish proceedings while awaiting a judicial decision or arbitration. The restriction applies to all the documents in the package; however, it in no way restricts NUJ and IFJ members from releasing excerpts (with accreditation) or opinion on content to interested third parties including news media. Future releases remain the prerogative of the editor and publisher.

As “Freelance Servicing Officer”, John Toner, UK National Freelance Organiser, acts in behalf of NUJ General Secretary. He holds responsibility for all union activities, organisation, and financial affairs related to freelance members. Under NUJ Rules, Toner also ranks as the first point of contact with NUJ officials and NEC officers for NUJ freelance members. Therefore, Toner has a responsibility to take immediate action on the content of this open letter and the attached documents that support its contentions.

The member requests Toner to insure that Jeremy Dear, NUJ General Secretary, includes the amended motion in the agenda for NUJ Finance Committee meeting on Thursday 25 June 2009 at 10:30 in the form presented. The amendment addresses the illegal activities of a kangaroo court session orchestrated during a previous meeting (18 Jun 08) and alleged quid pro quo by Dear and Mincoff (NUJ in-house solicitor) with Gareth Thomas MP.

At the previous meeting, NEC officers had an opportunity to recuse themselves by following the example of the Chair; instead, they chose knowingly to participate in illegal proceedings. The amended motion gives them a final opportunity to address the issues prior to filing civil and criminal charges against them, both jointly and severally. The amended motion gives them an opportunity to mitigate.

The member requests that the Chair, NUJ Finance Committee meeting to be held on Thursday 25 June 2009 agree to take a vote by secret paper ballot counted by independent tellers and make a tape recording of that part of the meeting which applies to the motion. The tape content should identify the speakers.

Audrey Witter, NUJ Minutes Secretary should send, by email attachment, a signed and dated copy of the minutes on an official NUJ letterhead within 48 hours of the close of the meeting. Those minutes must include a copy of the agenda, all documents distributed to participants that relate to the motion, and an MP3 file of the oral arguments and other proceedings.

London Freelance Branch/National Executive Council (NUJ/NEC) officer Phillip Sutcliffe allegedly interfered in the process (18 Jun 08) in collusion with NUJ officials Jeremy Dear, Roy Martin Mincoff, and Bernard Roche who denied due process and turned part of that meeting into a kangaroo court. They then coerced Audrey Witter, Membership Secretary to falsify minutes and withhold them for 7-1/2 months to prevent an appeal. Dear, Toner, Roche, and Witter have since withheld or concealed grievance rules and procedures which construes as obstruction of justice.

Since the kangaroo court, Dave Rotchelle, Phillip Sutcliffe, and Humphrey Evans (LFB officers) et al blocked an LFB motion for solidarity by neglecting to properly place it on the agenda and filibustered to prevent a vote. They used the meeting for criminal derogation and used a promotion of a course taught in the education and training program by Sutcliffe and Evans to filibuster. That continued a pattern or practice of public humiliation used over an extended period by another officer, Larry Herman. By that, they opened the door to investigation of the NUJ education and training program which allegedly showed misappropriation of NUJ and grant funds.

Dear made an outrageous response to reasoned inquiry about the filibustering. Investigation has included: quality of the demonstration; denial of access to information about officers paid to teach courses; level of adult instruction offered under various mandates; and, lack of academic and professional qualifications of some instructors who repeatedly deny access to their curricula vitae. That withholding, commensurate with exorbitant fees and failure to disclose payments to NUJ officers, also a lack of advertising of teaching positions to members generally, has denied equal opportunity employment in favor of sycophants.

Motion

That the motion previously submitted to a meeting of the Finance Committee 18 June 08 be resubmitted, as amended.

NUJ cabal has denied due process of law by fraudulently refusing NUJ services, holding a kangaroo court in an illegal cover-up of alleged criminal activity, and starting a smear campaign.

The motion amendment results from disclosures since the meeting (18 Jun 08) of an illegal quid pro quo between Jeremy Dear, NUJ General Secretary and the author's member of parliament, Gareth R Thomas MP (Harrow West), Minister of State, Department for International Development which revealed a distinct conflict of interest. It addresses government and NUJ dereliction and collusion in order to deny the member due process of law under international statutes.

David Cockburn, Certification Officer, Certification Office for Trade Unions and Employers' Associations delayed investigation and adjudication of a complaint for five months.

By that, Cockburn effectively granted Jeremy Dear, General Secretary, National Union of Journalists impunity to extend a seven-year pattern of illegal activity for another year.

Dear perverted the course of justice by misusing his position for personal gain and colluded in manipulation of elections to maintain an illegal status quo.

Dear also covered up misappropriation of public funds by denying access to financial and other records.

Cockburn effectively supported the illegal activities by delaying and denying justice.

Their respective actions show an illegal pattern or practice which has adversely affected trade union member
rights under the Trade Union and Labour Relations (Consolidation) Act 1992.
